Waiver

Acknowledgment of Risk

The undersigned hereby acknowledges being informed by the rental company that the rental of vehicles is potentially hazardous. The undersigned agrees to assume the risks associated with such activities.

Release, Indemnification, and Waiver

For and in consideration of the rights and use granted by the rental company, the undersigned Renter(s), individually and jointly with their families and users of the equipment, agree to:

• Fully release, indemnify, and hold harmless the rental company, their principals, agents, guides, employees, successors, and assigns from any and all claims or lawsuits arising from:
  • Negligence
  • Personal injury
  • Death
  • Property damage
  • Breach of contract
  • Deceptive trade practices
  • Fraud
  • Any other cause of action related to the use of the rented equipment.
• Further indemnify the rental company against any liability or damages, including reasonable attorney’s fees and expenses, in the event of litigation related to the use of the equipment.

The rental company is not liable for any accidents, injuries, or damages resulting from the renter’s failure to comply with applicable traffic laws, misuse, or negligent operation of the vehicle.

Binding Agreement

This Release/Waiver and Indemnity Agreement is binding upon:

• The undersigned Renter(s)
• Their spouse, heirs, legal representatives, and assigns
• Anyone who may make a claim on their behalf due to involvement in hazardous activities.

This agreement remains binding regardless of fault, including the negligence of the rental company or its associates.

Medical Treatment

If first aid or medical treatment is required due to participation in hazardous activities, the undersigned agrees to:

• Seek medical attention independently.
• Be fully responsible for any associated costs.

Security Deposit

The undersigned agrees to:

• A refundable security deposit of $100.00.
• Assume responsibility and pay for any damages to rental equipment while in their possession.
• Acknowledge that exceeding the allowed number of passengers in the vehicle will result in forfeiture of the security deposit.

Insurance and Exclusions

The rental company provides basic liability coverage. However, the renter is responsible for any damage or loss caused by misuse, including driving under the influence, exceeding the vehicle’s capacity, or engaging in reckless or unlawful behavior.

Vehicle Use

The vehicle must be operated on public roads and designated paths only. Off-road driving or use on private property, unauthorized trails, or other restricted areas is strictly prohibited.

Alcohol and Drugs

The use of alcohol or drugs is strictly prohibited while operating the vehicle. Any violations will result in the immediate termination of the rental agreement and forfeiture of the security deposit.

Rules and Regulations Acknowledgment

The undersigned confirms they have been informed of the rules, regulations, city ordinances, and island laws regarding the operation of rented vehicles.

Confirmation of Understanding

The undersigned confirms they have read and fully understand this document. By signing, they agree to all terms and conditions.

Vehicle Rules

• Drivers must be 23 years or older and possess a valid driver’s license.
• Do not drive off-road, on wet sand, or in saltwater.
• Do not drive on restricted roads or beaches.
• No alcohol consumption while driving the vehicle.
• Do not leave keys in the vehicle while unattended.

Infractions

Any violation of these rules may result in:

• Tickets or fines
• Forfeiture of the deposit and/or rental fee
• Additional charges billed to the credit card for tickets, fines, or damages.

Additional Notes

• Avoid driving over branches as they may have long thorns that can cause flat tires.
• Avoid using spray sunscreen in the vehicles as it is difficult to remove from windshields.
